DEFINITIONS

“Wild Photo Africa”, “we”, “us”, or “our” refers to Wild Photo Africa (Pty) Ltd. “Client”, “guest”, or “you” refers to any person making a booking or participating in a tour, safari, activity, or transfer arranged by Wild Photo Africa.

RATES & PRICING

  • All rates are quoted in South African Rand (ZAR) and are inclusive of VAT (15%), unless otherwise stated.
  • Prices are based on services, accommodation, park fees, fuel costs, and exchange rates applicable at the time of quotation.
  • Wild Photo Africa reserves the right to adjust prices if there are material increases in park fees, fuel costs, government levies, or supplier rates. Any such adjustment will be communicated prior to confirmation.

BOOKINGS & PAYMENT TERMS

  • A booking is only confirmed once a written confirmation has been issued by Wild Photo Africa and the required deposit has been received.
  • Unless otherwise stated:
    • A 30% non-refundable deposit is required to confirm the booking.
    • The balance is payable no later than 14 days prior to arrival.
  • For certain services or peak-season bookings, full payment may be required up to 75 days prior to travel. This will be clearly communicated at the time of booking
  • Payment may be made via bank transfer or other approved electronic payment methods. Banking details will be provided on the invoice. Credit Card payments via a Payment Link are preferred.

CANCELLATION & REFUND POLICY

Wild Photo Africa understands that travel plans may change. Our cancellation policy is designed to be fair and transparent while accounting for operational and supplier commitments.
All cancellations must be submitted in writing.

Standard Cancellation Terms

Unless otherwise stated in writing at the time of booking, the following applies:

  • 30 days or more prior to the activity or tour start date: Full refund, less any unrecoverable third-party costs already paid on the guest’s behalf.
  • Between 7 and 30 days prior to the activity or tour start date: 50% refund of amounts paid, subject to third-party supplier policies.
  • Less than 7 days prior to the activity or tour start date: No refund applies.

Short-Notice Bookings

For bookings made less than 7 days prior to the scheduled activity or tour:

  • Cancellations made within 48 hours of the scheduled start time: No refund applies.
  • Cancellations made more than 48 hours prior to the scheduled start time: A full refund may be applicable, subject to third-party supplier cancellation terms and recoverable costs.

Medical Emergencies

In the event of a medical emergency that prevents participation:

  • Official written documentation from a registered medical practitioner or hospital is required.
  • Where valid documentation is provided, Wild Photo Africa will offer a postponement or rescheduling of the activity at no additional cost, subject to availability.
  • Refunds remain subject to third-party supplier policies and recoverable costs.

Third-Party Services & Supplier Costs

Wild Photo Africa often makes advance payments to third-party suppliers, including but not limited to:

  • Accommodation providers
  • Park services and conservation fees
  • Sub-chartered vehicles or specialist guides
  • Activity and experience partners

Refunds for cancellations are strictly subject to the individual cancellation and refund policies of these suppliers.

Wild Photo Africa:

  • Cannot guarantee refunds for third-party services
  • Will only refund amounts successfully recovered from suppliers
  • Is not liable for supplier refusal to refund

No-Shows & Early Termination

  • No refunds will be issued for no-shows, late arrivals, or unused services.
  • No refunds apply for tours or activities terminated early by the guest for personal reasons.

Consumer Protection Act Compliance

Nothing in this policy is intended to limit any rights afforded to consumers under the Consumer Protection Act, 68 of 2008. All cancellation charges reflect reasonable costs incurred or committed by Wild Photo Africa.

QUOTATIONS

  • All quotations are valid for 7 days unless otherwise stated in writing.

  • A quotation is an estimate only and does not constitute confirmation of services.

  • A booking is only confirmed once a written confirmation and/or official invoice has been issued and the required payment has been received.

  • Wild Photo Africa reserves the right to correct genuine clerical, typographical, or pricing errors prior to confirmation.

  • In the event of any discrepancy between correspondence, quotation, and final invoice, the confirmed invoice shall take precedence.

  • All quotations are issued E&OE (Errors & Omissions Excepted).

PAYMENT APPLICATION & ADMINISTRATION

  • Payments must reference the correct invoice number and safari date.
  • Payments received without clear reference may result in booking delays.
  • Overpayments or underpayments resulting from administrative or clerical errors may be corrected upon notification.
  • Wild Photo Africa reserves the right to request settlement of any underpayment identified after payment has been received.
  • Electronic communication, digital confirmations, and electronic payments constitute legally binding acceptance of these Terms & Conditions.

CONSERVATION FEE ADJUSTMENTS

  • Conservation fees and park levies are determined by the relevant authority and may change without prior notice.
  •  Any increase implemented after quotation but before travel will be for the client’s account.
  • Wild Photo Africa is not responsible for changes imposed by park authorities.

TRAVEL INSURANCE

  • Comprehensive travel insurance is strongly recommended for all guests and should include cover for:
    • Medical emergencies
    • Personal belongings and photographic equipment
    • Trip cancellation or interruption
  • Wild Photo Africa is not responsible for losses that would normally be covered by travel insurance.

AUTHORITY TO BOOK

  • The person making the booking warrants that they have the authority to act on behalf of all guests included in the booking.
  • The booking party accepts responsibility for full payment and for communicating these Terms & Conditions to all participating guests.

CHANGES TO ITINERARY

  • Wild Photo Africa reserves the right to amend itineraries due to weather conditions, road closures, wildlife movements, park regulations, or other circumstances beyond our control.
  • Where possible, suitable alternative arrangements of equal or higher standard will be provided.
  • No refunds will be issued for changes made due to safety, conservation requirements, or park authority instructions.

RISK ACKNOWLEDGEMENT & GUEST RESPONSIBILITY

  • Guests acknowledge that safaris and outdoor activities involve inherent risks, including but not limited to wildlife encounters, road conditions, weather, and remote locations.
  • Guests agree to follow the instructions of their guide at all times.
  • Failure to comply with safety instructions may result in removal from an activity without refund.

LIABILITY

To the fullest extent permitted by South African law:

  • Wild Photo Africa, its directors, employees, guides, and agents shall not be liable for any loss, damage, injury, illness, death, delay, or expense arising from participation in any activity, except where caused by gross negligence or wilful misconduct.
  • Wild Photo Africa shall not be liable for loss or damage to personal property, including cameras, lenses, drones, luggage, or valuables.

Nothing in these Terms & Conditions is intended to limit any rights afforded to consumers under the Consumer Protection Act, 68 of 2008.

INDEMNITY

Guests agree to indemnify and hold harmless Wild Photo Africa against any claims, damages, or losses arising from:

  • Their own actions or omissions
  • Failure to follow safety instructions
  • Breach of park rules or South African law

Guests may be required to sign a separate indemnity form prior to participation in certain activities.

FORCE MAJEURE

Wild Photo Africa shall not be liable for failure to perform any obligation where such failure is due to events beyond our reasonable control, including but not limited to:

  • Natural disasters (floods, fires)
  • Park closures
  • Government restrictions
  • Strikes or civil unrest
  • Extreme weather conditions

In such cases, reasonable efforts will be made to reschedule or provide alternatives where possible.

PHOTOGRAPHY & MEDIA

  • Guests consent to photographs or videos taken during tours being used by Wild Photo Africa for marketing and promotional purposes, unless written objection is received prior to the tour.
  • Guests retain ownership of their own images

POPIA (DATA PROTECTION)

Wild Photo Africa complies with the Protection of Personal Information Act (POPIA).

  • Personal information is collected solely for booking, operational, and legal purposes.
  • Information will not be shared with third parties except where required to fulfil services or by law.

GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa, and any disputes shall be subject to South African courts.

NON-WAIVER

  • Failure by Wild Photo Africa to enforce any provision of these Terms & Conditions shall not constitute a waiver of its right to enforce that provision in the future.
